It can only be used when you lack mental capacity to make the particular decision yourself. You can also choose whether to give your attorneys authority over life-sustaining treatment.

Frequently Asked Questions
Can I make a legally valid will online in England and Wales?
Yes. A will can be prepared through an online service, but it must meet the legal requirements for validity. This normally includes signing it in the physical presence of two witnesses, who must also sign in your presence. Avoid using beneficiaries, or their spouses or civil partners, as witnesses because this can invalidate gifts to them.
Can I complete a Lasting Power of Attorney entirely online?
You can prepare LPA forms online. Under the current process, you must then print them, complete the required signatures, certification and witnessing, and arrange registration with the Office of the Public Guardian.
Do I need an LPA if I am married or in a civil partnership?
Marriage or civil partnership does not automatically give your partner authority to manage all your finances or make health and welfare decisions for you. An LPA allows you to appoint them formally, if that is your choice.
Is estate planning only for older people?
No. Adults of different ages can benefit from planning ahead. Buying a home, becoming a parent, entering a relationship or taking on financial responsibilities can all be reasons to consider a will and LPAs.
Does making a will automatically reduce Inheritance Tax?
No. A will can form part of appropriate estate planning, but making one does not automatically reduce Inheritance Tax. The outcome depends on your estate, beneficiaries, available exemptions and the rules that apply.
